Participation Terms & Process

By registering, you agree to the terms and conditions set out below.


1. Who are we?

The Uitzendclaim.nl Foundation supports participants in a potential collective claim against temporary employment agencies due to possible disadvantages suffered by temporary workers and seconded employees.


2. What is the claim about?

The claim concerns possible financial and/or non-material damages, such as unpaid wages, missed accruals or reservations, incorrect deductions, or unequal treatment.


3. No Upfront Costs

Participation is based on a no cure, no pay arrangement. You do not pay anything upfront for participation or legal representation.


4. Compensation in Case of Success

Only if compensation is recovered may a fee be deducted to cover costs incurred and work performed:

  • Standard: 25% including VAT of the amount recovered.
  • In proceedings up to and including the Dutch Supreme Court (Hoge Raad): a maximum of 30% including VAT (in line with WAMCA).

The remaining amount belongs to you.

Naturally, we will also seek to recover our costs from the relevant temporary employment agency so that you may receive 100% (!) of your damages and wage reimbursement. Unfortunately, no guarantees can be given that these parties can be compelled to do so voluntarily. That is why justice must prevail.


5. Representation

By registering, you authorize the Uitzendclaim.nl Foundation to act on your behalf in the claim, negotiate, take legal action, and, where necessary, conclude a settlement.

In accordance with WAMCA, the independent Sti Uitzendclaim Foundation is the leading organization and operates on a non-profit basis. The foundation is neither dependent upon nor accountable to the major litigation funders who demonstrate exceptional commitment by investing many millions of euros to make this mass claim possible. However, such funders have no authority or control over the Uitzendclaim.nl Foundation.

In mass-damage cases such as this, it is customary for courts to first determine whether they have jurisdiction to hear the case and whether the representative organization bringing the collective action satisfies the strict requirements imposed by WAMCA (the Dutch Act on the Resolution of Mass Damages in Collective Actions).

We comply with all requirements of the Claim Code as well as the governance code that prescribes how representative organizations seeking to bring collective actions must be structured and governed.


6. No Guarantee of Success

Legal proceedings always involve uncertainties. No guarantee can ever be given regarding success, compensation, or the speed with which the matter will be resolved.


7. Your Obligations

Please provide only accurate information and your (digital) signature, and cooperate when requested, for example by supplying payslips, employment contracts, or other supporting evidence.

False documents, forged or copied signatures, and/or fraudulent damage claims will not be accepted and may be reported to the relevant authorities.

In doing so, we protect the entire group of hundreds of thousands of bona fide clients and affected individuals. Please expressly acknowledge this.


8. Privacy

Your personal data will be processed in accordance with the applicable and legally required GDPR regulations and will only be used for the handling of your file and the claim.


9. Withdrawal / Cancellation

You may withdraw your participation free of charge within 14 days after registration, exclusively by email to:

10. Communication

We will keep you informed by email and/or through the website about important developments in the proceedings.

In addition, third-party professionals engaged by us may contact you on our behalf regarding such developments.


11. Applicable Law

This agreement is governed exclusively by Dutch law.

Sti Uitzendclaim.nl is an independent Dutch foundation.



12. Agreement

By registering, you declare that you have read these Terms and Conditions and agree to them.

  • Your agreement also includes confirmation that you are participating exclusively in our collective claim and are not participating in any other similar initiative.
